The State of Montana has the tort car insurance system which means that drivers who are responsible for the accident must also be responsible for the damages and injury resulting from the accident. All drivers driving on the roads and highways must have proof of car insurance for Montana. Under the Montana Code Annotated 61-6-301, drivers should have it inside the car in case of accident or if they are requested by the officer of the law to present it. The required minimum car insurance liability for Montana is $25,000 for bodily injury for one person per accident, $50, 000 for bodily injury for two or more persons per accident and $10,000 for property damage. Under the law, the liability insurance is mandatory except for motor vehicles.

The state considers driving an uninsured vehicle a misdemeanor and if you are caught driving without your proof of car insurance, you will have to pay an amount of $250 to $500 or may even have to stay in jail for up to 10 days. You will have five points on your license and you know that 30 means your license will be revoked. And thats if it was only your first offense. If you are a second time offender, you will have to pay a fine of no less than $350. You may also have to stay in jail for not more than 10 days. Your license will also be suspended for ninety days. The state determines the car insurance rates for motor vehicles based on your age, gender, area of residence, type of your vehicle and your driving records and habits. This means that the cleaner your record, the lower your rate will be.

The state also requires insurance companies to offer you uninsured motorist coverage although you are not required to purchase this. Nevertheless, it is better to purchase this additional coverage for your own protection in case the driver responsible for the accident does not have insurance.
